Trade name, business sign, trademark, company name… these terms sound similar but protect very different things. Confusing them is one of the most common mistakes made by Moroccan entrepreneurs.
The risk? Believing your name is protected when it is not, only to discover that a competitor is using it or registered it before you. This guide explains each concept, shows which one truly protects your identity and details the trademark registration process with OMPIC.
Four concepts you should no longer confuse
Before establishing or protecting your identity, distinguish these four elements. Each serves a different purpose and offers a different level of protection.

Company name and negative certificate
The company name is your company's official name, which appears in its articles of association and Commercial Register. It is the legal identity of the legal entity.
To reserve it, obtain a negative certificate from OMPIC, which checks that no other company already uses the name. Be careful: reserving a company name does not mean you own a protected trademark. This is a very common misunderstanding with serious consequences.
Trade name: the name you do business under
The trade name is the name by which customers know your business. It may match the company name or differ from it, for example a customer-facing name distinct from the legal name.
It is attached to the business and benefits from some protection through use, but that protection is geographically limited and weaker than that of a registered trademark.
Business sign: the visible identifier of your premises
Thebusiness sign is the sign — a board or logo on the facade — that physically identifies your outlet and makes it recognisable. It plays a major commercial role, especially for local shops.
Like a trade name, a business sign is protected through use, but this does not replace trademark registration, which alone gives you exclusive rights over the sign.

The trademark is a distinctive sign (name, logo or slogan) that you register officially to protect your goods and services. It offers the strongest protection under industrial property law.
A registered trademark grants you exclusive use and the right to take legal action against imitation or unauthorised use. It turns your name into a genuinely protected asset.
Registering a trademark with OMPIC
The trademark registration is handled by OMPIC, the Moroccan Office of Industrial and Commercial Property. You choose the classes of goods and services concerned, check that the sign is available, then submit your application. Protection then runs for a renewable term.

Trademark renewal and revocation
Trademark protection does not automatically last forever: it must be renewed periodically with OMPIC. Missing a renewal can leave your trademark unprotected and open to use by others.
Also be aware of revocation for non-use : a trademark left unused for a long period can be challenged. Registering a trademark therefore means genuinely using it in business.
What should you do if your trademark is imitated?
If a competitor uses an identical or similar sign in the same classes, a registered trademark gives you grounds to act: a formal notice, opposition or even infringement proceedings. Without registration, your remedies are much more limited.
